A judge has ruled that a May 2011 psychological evaluation of  Hemy Neuman must be made available to the state.

On Jan. 11, DeKalb County Superior Court Judge Gregory A. Adams ordered psychologist Peter Thomas to transmit all records of his evaluation of Neuman to the court for review by the end of the day Jan. 12.

The order comes after a Jan. 4 pre-trial hearing, in which Neuman’s attorneys argued that Thomas’ evaluation was privileged information that was never meant to be used in court.

Prosecutors said the psychologists notes should be available for them to review since Neuman pleaded not guilty by reason of insanity.

Neuman is accused of the Nov. 2010 shooting of Rusty Sneiderman outside of a Dunwoody preschool.
