The Grant Park Neighborhood Association has filed a court appeal to reverse the City of Atlanta Planning Department’s approval of a special administrative permit (SAP) for a big-box development at 800 Glenwood Ave. According to a report in East Atlanta Patch, the association and two residents – Danny Leonhardt and Susan Walens, filed the appeal with the Fulton County Superior Court.
The court appeal is the latest salvo by residents who are trying to stop Fuqua Development from building a big-box development, rumored to be a Walmart, on the property that is adjacent to the Atlanta BeltLine. Last month the Atlanta Zoning Board of Adjustment decided that the neighborhood association and residents did not having sufficient legal standing to request an appeal to the SAP.
Both Fuqua and Lafarge, the concrete company that owns the Glenwood property, have filed lawsuits against the city after the Atlanta City Council voted in September to retro-actively rezone the Glenwood Avenue property from industrial to mixed-use residential.
